Oakland Mayor Jean Quan said Thursday that her city was prepared to handle possible protests organized in response to the Monday release of former BART Police Officer Johannes Mehserle from a Los Angeles County Jail.

In a written statement, Quan said, “Although we expect peaceful gatherings, we do not anticipate nor will we tolerate vandalism or violence. The Oakland Police Department is prepared to respond if personal safety or property are at risk.”

Johannes Mehserle, the former BART police officer jailed for fatally shooting and killing an unarmed train passenger at an Oakland station in 2009, will be released on Monday, the Oakland Tribune reported Wednesday evening.

The newspaper quoted family members of Grant who said officials from the California Department of Corrections and Rehabilitation told them that Mehserle was due for release from the Los Angeles County Men’s Jail in Downtown LA after serving a sentence for an involuntary manslaughter charge.

Marysol Domenici, the former BART Police Officer who was accused of lying during testimony in the murder trial for Johannes Mehserle and fired by department brass, will be given her former job back after a labor arbitrator overturned the agency’s termination.

Domenici, 30, appealed the Mar. 25, 2010 firing after an independent review panel hired by the agency to examine the fatal police shooting of unarmed train passenger Oscar Grant by Mehserle found that Domenici was untruthful in how she described the event.

LOS ANGELES – A Los Angeles judge denied bail to former BART Police Officer Johannes Mehserle at a hearing Friday afternoon, dismissing a defense motion that sought the release of the former transit officer from jail pending an appeal of his involuntary manslaughter conviction.

“This court sincerely believes [Mehserle's conviction] will not be reversed” on appeal, Los Angeles Superior Court Judge Robert Perry explained.

Johannes Mehserle, the former BART Police officer sentenced to two years in state prison for the shooting death of Oscar Grant in 2009, will return to Los Angeles County Superior Court on December 3 for a bail hearing, according to the Court.

Mehserle’s defense has requested that Los Angeles Superior Court Judge Robert Perry allow Mehserle to be released on bail pending an appeal of his involuntary manslaughter conviction. If Perry grants the motion, Mehserle could be released from custody after posting bond.

OAKLAND — A raucous public demonstration against the minimum sentence delivered to Johannes Mehserle turned into a nighttime march through the streets of Oakland Friday night, resulting in more than one hundred arrests and leaving two people injured, including a police officer.

Police estimate approximately 500 people gathered in front of Oakland City Hall at Frank Ogawa Plaza to decry Los Angeles County Superior Court Judge Robert Perry’s decision to assign the former BART Police officer a two-year sentence with a 292 day credit for good behavior for the shooting death of Oscar Grant at the Fruitvale BART station on January 1, 2009.

Johannes Mehserle, the former BART Police officer who was convicted in July of involuntary manslaughter in the 2008 shooting death of Oscar Grant, sat down for his first interview with a reporter since the New Year’s Day incident.

Mehserle spoke with KTVU Television from the Los Angeles County Men’s Jail where he has been held since the verdict announcement. The interview will air on Channel 2′s 10 p.m. news Thursday evening.

A crowd of about 20 advocates for Johannes Mehserle gathered in Dublin yesterday to show their support for the former BART police officer in jail for killing an unarmed train passenger last year.

The rally was held in front of Dublin City Hall; it was the third public demonstration in Mehserle’s defense since July 8, when a Los Angeles jury found him guilty of involuntary manslaughter for fatally shooting Oscar Grant.

OAKLAND — An armed man being chased by police led officers into a BART subway tunnel Wednesday afternoon causing the transit agency to shut off power to trains at the Lake Merritt station.

The foot chase by BART and Oakland Police led to delays of up to 30 minutes for riders traveling in the East Bay because of the power shutdown at approximately 12:15 p.m., the agency reported.
